1. Service Overview

Muryou Aigazou ("the Platform", "we", "us") provides a free AI-powered image generation service. Certain premium features, including video generation, advanced editing models, and fast-mode processing, require Credits, a virtual currency purchased through third-party payment processors.

By accessing or using our Platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Eligibility

• You must be at least 13 years old to use this Platform.
• If you are located in the European Economic Area (EEA), you must be at least 16 years old, or have verifiable parental or guardian consent.
• By using the Platform, you represent that you meet these age requirements.

3. Accounts & Payments

• You are responsible for providing truthful and lawful payment information and for all transactions made under your account.
• All payments are processed by third-party payment providers. We do not store your complete payment information, such as full credit card numbers.
• You are responsible for maintaining the security of your account credentials.
• We are not responsible for issues caused by payment failures, bank declines, or currency exchange fluctuations.

4. Credits

• Credits are a virtual commodity used solely for consuming premium features on this Platform.
• Credits cannot be withdrawn, transferred to other users, or exchanged for cash under any circumstances.
• Free Credits may be claimed daily, subject to rules published on the Platform.
• Purchased Credits are generally non-refundable. If you are unsure whether a paid feature meets your needs, we encourage you to claim free Credits first to try it out.
• Refunds may be issued at our sole discretion in cases of verified system errors that resulted in incorrect charges.
• Pricing and Credit consumption rates may change at any time. We will provide reasonable advance notice of material pricing changes.

5. Acceptable Use

You agree NOT to use the Platform to:

• Generate, upload, or distribute content that is illegal, infringing, pornographic, sexually exploitative, violent, hateful, discriminatory, or fraudulent.
• Generate content that exploits or harms minors in any way. CSAM is strictly prohibited and will be reported to authorities.
• Circumvent content moderation or safety systems.
• Engage in automated abuse, including bot-driven bulk generation, rate-limit evasion, or API scraping.
• Impersonate another person or misrepresent AI-generated content as human-created.
• Use generated content for illegal activity or to infringe on others' rights.

You are solely responsible for any legal risks arising from content you generate or upload, including copyright, trademark, and publicity or personality rights.

6. Fraud & Violation Enforcement

If we detect or reasonably suspect fraud, chargebacks, or other abnormal transactions associated with your account, we reserve the right to:

• Freeze or suspend your account;
• Revoke any Credits, including purchased Credits;
• Restrict or permanently terminate your access to the Platform.

Account termination due to violations will result in forfeiture of all remaining Credits without refund.

7. Generated Content & Intellectual Property

• Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable license to use images you generate on the Platform for personal and commercial purposes.
• The copyright status of AI-generated content varies by jurisdiction. We make no representations or warranties regarding copyright ownership of generated images.
• By publishing generated images to the public Gallery, you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute those images on and in connection with the Platform.
• We reserve the right to remove any content from the Platform at our discretion, including content that violates these Terms or applicable law.
• If you upload images, such as for image-to-image editing, you represent that you have the right to use those images and that they do not infringe on third-party rights.

8. Disclaimer of Warranties

• The Platform and all services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
• We do not guarantee the quality, accuracy, or suitability of AI-generated results.
• AI models available on the Platform may be changed, updated, or discontinued at any time without prior notice.
• Free tier availability, daily claim amounts, and free features may be adjusted at any time.
• We make reasonable efforts to moderate generated content but cannot guarantee that all inappropriate content will be prevented or detected.

9. Limitation of Liability

To the maximum extent permitted by applicable law, our total cumulative liability to you for any and all claims arising from or related to the Platform shall not exceed the total amount you have actually paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Modifications to Terms

• We reserve the right to modify these Terms at any time. Material changes will be communicated via the Platform, such as a banner notification or email where applicable.
• Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
